Looking deep into the history, in ancient Greeks of the times of Aristotle and Plato, they revolted
against the autocratic rule of kings and shaped their city states of Rome and Athens, Sparta as the
bastion of democracy. The united states of America during its initial years of emergence embraced
democratic form of government. Abraham Lincoln defined it as “ Government of the people, by
the people, for the people.” But its practice right at that time was clung to the most powerful and
influential rulers who flouted the common man’s mandate in order to take sovereign decisions.
Yet, democracy is reshaped has lost its originality and existence. However, nigh- underdeveloped
countries in particular, democracy is solely chanted in letters by perpetrators. Feudal and elitists
have replaced the kings, the dictators, the despots and the tyrannical rulers. Nexus of such people
may be on their personal influence over common man or any kind of horror towards them can
broaden their route and finally pave the way to come in power. Days later, they indulge in their
game of fraudulence and plunder the country in the name of democracy. This is what happening
now in Pakistan.
Democracy in its various forms varies from country to country. The only way to protect democracy
is the rule of law. It did not permit or allows one man or any dynasty such like kings or any other
offenders to retain absolute power over other people of the society. According to Aristotle, the rule
of law is blessed with divine sanction- It is natural law as opposed to the man-made laws. Divine
laws are governing gravity, movement of earth etc. Though they move with high accuracy and
perfection without letting any moment going for and against. Now, as the case pf democracy- It is
the intrinsic practice of the rule of law- Not having of so much democracy can be truncated in all
forms. Even though it saves the nation from the danger of one man rule. It provides sense of
participation to the whole nation in the affairs of the state. However, feudalist and elitists impose
their own rule over the people of lower class, but this happens when such culprits take over the
rule and make accountable to the weaker ones at all stages.
The primary and most fundamental juridical function is to settle the disputes between the citizens and the state. To make the judiciary self-governing , independence of the
rule of law is prominently needed. All the time courts keep on adjourning hearing without any
justification. So can be said: justice delayed is justice denied. Unsettled disputes are at the top of
the heap. Common man’s peace of mind and tranquility of soul is vanished all around. To whom
one should call for the justice, where there is feudal in power and poor beneath their knees. until
then, anti-feudal forces should manage to keep these tiny class out of political process. As everyone
is independent to live and survive accordingly. The rule of law- the guiding divine light that
brightened humanity highway to get out of the age of barbarism and pass over to the era of dictators
and kings then on to the philosophical age of democracy. Juridical system in Pakistan is suffering
from its imperfection. It failed to provide humanity access to justice. Islamic democracy if put in
practice in Pakistan most importantly would make man’s life blissful. And the jurisdiction need to
come up with its sanction. None of the countries in all has cared to adopt so far.
